1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Pergamon platform, website, and related services (collectively, the "Service") provided by Pergamon Labs Limited ("Company", "we", "us"), operating under the Pergamon Labs brand.

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Service Description

Pergamon is an AI-powered technical documentation platform that enables users to create, translate, and export product manuals. The Service includes AI content generation, multilingual translation, template management, and document export functionality as described on our website and in your subscription plan.

3. Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorised use of your account. We are not liable for any loss arising from unauthorised access to your account.

4. Subscriptions and Payments

• Subscriptions are billed monthly. Prices are listed on our pricing page and may be updated with 30 days' notice.
• Payment is due at the start of each billing cycle. A valid credit card is required for all paid plans.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.
• Free trials are limited to the terms described at sign-up (typically 7 days, 3 product categories, watermarked exports).
• We reserve the right to suspend access for non-payment after a 7-day grace period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Share, resell, or sublicense your account access to third parties without authorisation
• Upload content that infringes on the intellectual property rights of others
• Attempt to circumvent usage limits, security measures, or access controls
• Use automated tools to scrape, harvest, or bulk-extract content from the platform

6. Intellectual Property

Your content: You retain ownership of all content you create, upload, or store in the Service. By using the Service, you grant us a limited licence to process your content solely for the purpose of providing the Service.

Our platform: The Service, including all software, templates, AI models, branding, and documentation, is owned by Pergamon Labs Limited and protected by intellectual property laws. Nothing in these Terms transfers ownership of our intellectual property to you.

Pre-built content: Regulation-based content blocks, safety statements, and template structures provided by Pergamon are licensed for use within your generated documents only. They may not be extracted, redistributed, or used independently outside of Pergamon-generated outputs.

7. AI-Generated Content

The Service uses AI to assist with content generation and translation. While we strive for accuracy, AI-generated content is provided as a starting point and may require review.

Pergamon does not guarantee legal compliance of generated content. Final responsibility for the accuracy, completeness, and regulatory suitability of your product documentation remains with you, the brand owner. We recommend that you review all generated content before publication.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with these Terms or the use of the Service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

9. Warranties and Disclaimers

The Service is provided "as is" and "as available." We make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. We do not warrant the accuracy or completeness of any AI-generated content.

10. Termination

Either party may terminate these Terms at any time. You may cancel your subscription through your account settings or by contacting us.

We may suspend or terminate your access immediately if you violate these Terms, fail to make payment, or if required by law. Upon termination, your right to use the Service ceases immediately.

You may request an export of your content within 30 days of termination. After this period, we may delete your data in accordance with our Privacy Policy.

11. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR). Your content is hosted on AWS servers within the European Union and is encrypted at rest and in transit.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

If you are an EU consumer, you retain the benefit of any mandatory consumer protection provisions of your country of residence.

13. Changes to These Terms

We may revise these Terms from time to time. Material changes will be notified at least 30 days in advance via email or a prominent notice on our website. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
